Gun Laws in Virginia Can Be Complicated

Cody Villalon Answers Your Frequently Asked Questions

Owning a firearm in Virginia is both a right and privilege. Those choosing to take advantage of this right must abide by the laws set forth by the state. As you may have recognized, the laws governing this right are incredibly complex; nuances play a major role. Below Cody Villalon has answered some of the questions he hears most often with regard to firearm ownership in the state.

Do I need a permit and must I register my firearm for open carry?

In most cases the answer is no, as long as the gun you own is either a handgun or a long gun with a magazine of 20 rounds or less.  The exception is assault weapons for which a federal permit is necessary for open carry.

Are criminal background checks required for the purchase of a gun?

Yes, the state requires that all sellers, both public and private, conduct a criminal background check prior to selling a firearm.

Can I open carry my weapon on school property?

No, Virginia does not allow for open carry on school property. It is also prohibited in courthouses, airports, and places of worship, among others.

If I want to conceal carry, do I need a permit?

Yes, you need a state-issued permit to carry a concealed handgun.

Gun Owners Must Abide By Virginia Gun Laws

Understanding Restrictions

While open carry without a permit is legal in Virginia, gun owners are still required to act responsibly. Consider some of the laws which those who possess firearms must follow:

  • You cannot discharge your firearm in a public location or inside of a building.
  • If you have been convicted of a felony, you cannot own a gun.
  • You cannot discharge your gun in a motor vehicle.
  • You cannot possess a gun and a controlled substance at the same time.
  • You must be 21 years of age to be eligible to open carry. (Those under the age of 21 can possess a gun on their own property or the property of their legal guardian or their grandparents. Additionally, if they are on private property with permission from both their parents and the property’s owner, possession is permitted.)

Disregarding the laws above can result in felony charges. If convicted, you may face costly fines and even jail time, depending upon the seriousness of the crime. That said, it is important to realize that even seemingly minor gun charges like possession can have a significant impact on your life. Those facing firearms charges should immediately engage a seasoned Virginia criminal defense attorney to help protect their rights and their future.
